High Court sitting in Ogbomoso has ordered the eviction of players of the Crown Football Club of Ogbomoso from their hotel facility at Idi-Abebe, Taki area Ogbomoso, a property belonging to late Chief P. Ogunniyi family over the breach of covenant.

This was as a result of the management of the club to fulfill the contractual agreement between the club and the claimant for ten years.

Delivering his judgment in a suit instituted by Mr. Adekunle Ogunniyi on behalf of the family, Justice G. A. Sunmonu held that the sum of N10 million be paid to the plaintiff as a cost of general damages for each of the years spent.

This judgment came after 10 years of breach of agreement by the defendants which included the state government, Attorney General and Commissioner for Justice, Commissioner for Youth and Sports and the management of Crown Football Club, Ogbomoso.

According to the judgment delivered on March 2, 2018, Justice Sunmonu ordered that, “declaration that the relationship between the claimant’s family and the defendants is the landlord and tenant.

“Declaration that the sum of N2 million paid by the 4th defendant for a period of 10 years lapsed on the 31st day of December, 2018.

“That act of the 4th defendant being sponsored by the 1st and 3rd defendants in demolishing and rebuilding the structure is a breach of usual covenants.

“That an order evicting the 1st, 3rd and 4th defendants and their agents from the property is issued.

“That the sum of N1 million as general damages against the 1st defendant.

“That injunction restraining the 1st, 2nd, 3rd and 4th defendants from parading themselves as the owners of the property is issued.

“That cost of N100, 000.00 be awarded in favour of the claimant and against the defendants,” the judgment reads.

Meanwhile, failure on the part of the defendants to obey the court judgment of march 2, 2018 led to the eviction of the occupiers (players of the Crown FC) of the property in question, as the eviction order was carried out on April 29, 2022.

Confirming the incident, the General Manager of the Crown Football Club, Kunle Oyeleye, disclosed that the court has given the order and it has been executed.
